Right of way and rights to light

If a right of way has been interfered with, or there is a right of way over your land that is the subject of a dispute, we can help find an effective solution, either through negotiation or court action where required.

We are proud to have successfully won many cases over the years through methods of alternative dispute resolution, as well as cases that needed to go to court.

If the light to your property has been obstructed by a neighbour’s property, or a neighbour claims your property is obstructing their right to light, we can work with both parties to find an acceptable resolution, or if it is necessary, we will assist with initiating or defending against court proceedings.

Our family law expertise

Divorce

Our expert divorce solicitors can assist with all matters related to family law, divorce and separation, including making practical arrangements for finances and children.

If you are in the process of getting a divorce, our solicitors can help you make arrangements for your family at this difficult time and help you protect your interests for the future, without any unnecessary costs and delays.

Our divorce solicitors have experience handling a range of legal matters including no fault divorce, prenuptial and postnuptial agreements, civil partnership dissolution and financial settlements.

Divorce financial settlements

Our solicitors specialising in divorce and financial settlements can help you reach an agreement with your former partner about how your assets will be divided.

We are experts in using Alternative Dispute Resolution Methods such as mediation and arbitration to help couples come to an agreement.

Where an agreement cannot be reached we have the necessary expertise to represent your best interests during court proceedings and advocate for a positive outcome.

Child law

Our child law solicitors can help separated couples reach an agreement about child arrangements.

We aim to resolve disputes without the need for court proceedings, choosing to use Alternative Dispute Resolution methods such as mediation or arbitration to come to an agreement first.

If matters cannot be resolved in this way, we can help you apply to the court for a Specific Issue Order.

Our child law solicitors can provide advice on a range of matters including child arrangements, child maintenance and parental responsibility.

Child arrangements

Our child arrangements solicitors will aim to help former couples decide on child arrangements without involving the court where possible.

If an agreement is reached without legal intervention or through processes such as mediation, it can be formalised into a consent order and approved by the court, providing both parties with a legally binding agreement.

However, in some cases, it may not be possible for both parties to come to an agreement on living arrangements or a schedule of contact. In such cases, the court can be approached to help resolve the dispute and we can represent the best interests of your family.

Parental responsibility

It is important for every child to have someone who looks out for their best interests and takes responsibility for their welfare.

Biological parents automatically receive parental responsibility but the law allows individuals to apply for parental responsibility alongside them.

These individuals may include unmarried biological fathers, step-parents, grandparents, civil partners and same-sex partners, special guardians, and local authorities.

If you believe you should have parental responsibility for a child and would like to learn more about the process from a family law expert, our solicitors can assist you.

Cohabitation

Unlike marriage, there are few legal protections for cohabiting couples which is why having an agreement in place can help prevent disputes in the future.

Our cohabitation solicitors can help unmarried couples who live together make provisions for their assets, children and property in the event that your relationship breaks down.

We can assist with producing a cohabitation agreement, a declaration of trust or Wills to provide both parties with peace of mind for the future.

Civil partnership dissolution

If you have entered into a civil partnership and are going through a separation, the process is quite similar to a divorce.

It involves a legal process that must be followed and one or both parties must provide a statement of irretrievable breakdown.

Our civil partnership dissolution solicitors will manage the process on your behalf to make it as stress-free as possible. We take the time to fully understand your priorities and provide you with all the necessary information to make decisions in your best interests.

Prenuptial agreements

A prenuptial agreement, commonly known as a prenup, is a contract that couples enter into before they get married. It is advisable to do this well in advance of the wedding day. The agreement outlines how their assets will be divided in the event that they divorce.

Our prenuptial agreement solicitors can help you create a prenuptial agreement that meets the needs of both parties and protects your future interests.

Postnuptial agreements

A postnuptial agreement is very similar to a prenuptial agreement except it is made after a couple marries rather than before.

Over the course of a marriage, your circumstances can change over time including your wealth and assets.

Our solicitors can help you create a postnuptial agreement to ensure that your wishes are kept up to date, providing security for the future.

Grandparents' rights

Grandparents unfortunately do not have automatic rights to see their grandchildren in the event that their child divorces their partner.

In practice, family courts recognise the importance and benefits of children spending time with their grandparents and there is a legal process to help you maintain a relationship with them.

Our grandparent’s rights solicitors can support you through this process and help you retain the right to see your grandchildren.
